Introduction

VIZIO, Inc. ("VIZIO") respects your privacy. This Privacy Policy applies to all of our web sites, our products, services, VIZIO’s features for Smart Interactivity (see below), as well as that portion of the VIZIO Internet Apps® and VIZIO Internet Apps® Plus ("V.I.A. Services") controlled by VIZIO (collectively "VIZIO Products and Services"). This Privacy Policy explains what information we collect, how we collect the information, how we protect the information and how we use or disclose that information. Information is collected whenever you interact with VIZIO, such as when you visit our website, when you purchase or register VIZIO Products and Services, when you contact our sales or technical/customer support representatives or obtain support or warranty service, and during the course of normal use of your VIZIO product. Your privacy is a priority at VIZIO, and we take responsible measures to protect it.

VIZIO's web sites may contain links to other web sites. V.I.A. Services allow you to access third party data servers from certain VIZIO HDTVs, Co-Star streaming players or from other similarly enabled products. This Privacy Policy does not apply to the practices of any company or individual that VIZIO does not control or any web sites or V.I.A. Services that you access from the VIZIO Products and Services. You should use caution and review the privacy policies of any web sites, services or third party providers of V.I.A. Services that you visit from VIZIO's web site or VIZIO Products and Services to learn more about their information practices, which may be significantly different from VIZIO's.

By accessing and using VIZIO Products and Services, you agree to accept the terms and conditions of this Privacy Policy, you consent to our use and disclosure of the Personally Identifiable Information submitted to us, and you acknowledge that you are aware that this policy may change over time. This Privacy Policy is not intended to, and does not, create any contractual or legal rights in or on behalf of any party.

What information we collect

When you interact with VIZIO, we may collect personal information relevant to the situation, such as your name, mailing address, phone number, email address, and contact preferences; your credit card information and information about the VIZIO products you own, such as their model numbers, serial numbers and date of purchase; and information relating to a support or service issue - the "Personally Identifiable Information.” For example, we collect Personally Identifiable Information when you register a VIZIO Product or Service, access certain V.I.A. Services, contact us for warranty service or customer or technical support, enter a sweepstakes or participate in promotions and giveaways. From time to time in the future, we may offer additional products, features, services and promotional opportunities that would require you to submit Personally Identifiable Information to VIZIO in order to participate.

We also collect "Anonymous Information" such as your IP address on certain VIZIO products, your ZIP code, the hardware and firmware version of your V.I.A. Services capable product, and the V.I.A. Services you visit, as well as information about your VIZIO product such as MAC addresses, product model numbers, software versions, chipset IDs, and region and language settings. Anonymous Information also includes information about the products you request or purchase, the presence of other devices connected to your local network, and the number of users and frequency of use of VIZIO Products and Services. VIZIO will also collect specific viewing information (as described below under the heading “Smart Interactivity”). We also collect Anonymous Information regarding customer activities on our websites, V.I.A. Services, and VIZIO's Internet Store. Some Anonymous Information may be associated with Personally Identifiable Information.

VIZIO also uses "cookies" to collect information when you visit VIZIO's web site. A cookie is a small data file that VIZIO transfers to your computer and is stored on your hard drive. Cookies are used by thousands of web sites in order to enhance the web site experience. When you visit VIZIO's web sites, the cookie identifies your computer to us so that you do not have to re-register each time you visit. We also use cookies to anonymously measure the traffic to our site and its different services and features.

VIZIO recognizes that parents, guardians, or other adults often purchase our products for family use, including use by minors. We will not knowingly collect Personally Identifiable Information from children under age 13 for any purposes nor will we knowingly accept registration from them, but because some information is collected electronically, it can appear to be the Personally Identifiable Information of the VIZIO purchaser of the product, and will be treated as such by this Privacy Policy. If a child under age 13 submits Personally Identifiable Information to VIZIO and we learn that the Personally Identifiable Information is the information of a child under age 13, we will attempt to delete the information as soon as possible or take any other measures required under applicable law.

Smart Interactivity

Certain internet-enabled VIZIO Products and Services may include a feature enabling VIZIO to collect information from your product and to trigger events based on that information (see below for a description of the kinds of information VIZIO collects). Such events may include pop-ups on your screen to provide further information about what you are viewing and may include advertising. This feature is generally known as “Smart Interactivity.” VIZIO will track and collect the information related to Smart Interactivity (described below) in a manner that is consistent with this Privacy Policy.

When Smart Interactivity is enabled, VIZIO will collect specific viewing information, including but not limited to the identity of your broadcast, cable, or satellite television provider, the television programs and commercials you view (including time, date, channel, and whether you view them live or time-shifted), and whether you click on any advertisements.

You will be afforded the opportunity to disable and opt-out of Smart Interactivity directly from the menu of your VIZIO products. For instructions on how to disable and opt-out of Smart Interactivity, visit http://store.vizio.com/smartinteractivity. If you are unable to locate the opt-out menu on your VIZIO Product, contact VIZIO customer service by emailing [email protected] or calling 877-698-4946. Choosing to opt-out will disable the Smart Interactivity features on the VIZIO product where you have made that selection. However, even if Smart Interactivity is disabled, VIZIO may still collect Personally Identifiable Information when such information is provided by you to VIZIO, for example in the case of a support request or when participating in a promotion, as described in this Privacy Policy, and may still collect Anonymous Information from sources other than Smart Interactivity.

How we use the information we collect

We use Personally Identifiable Information that you provide us for such purposes as responding to your requests for information, products or services, support, customizing the advertising and content you see, and communicating with you about VIZIO Products and Services or our other offerings. For example, if you sign up for our email newsletter, we will send the newsletter to the email address you provided. We will also use Personally Identifiable Information to send you information about products and services that may be of interest to you, from VIZIO and our third party partners. However, we may also initiate communications for other reasons including the above purposes, such as support, purchases, and information requests, using the Personally Identifiable Information in VIZIO's possession. You will always have the opportunity to "opt out" by unsubscribing or otherwise decline to receive further communications. Later on in this Privacy Policy, we provide you with more information on how to view, modify or remove your Personally Identifiable Information.

We use Anonymous Information to determine how people use the VIZIO Products and Services. For example, this data tells us information including how often users click on advertisements, which files are downloaded most frequently, and which V.I.A. Services are the most popular. Analyzing this data allows us to improve the offerings on and performance of VIZIO Products and Services. You may not elect to block VIZIO’s collection of Anonymous Information.

VIZIO may combine the Personally Identifiable Information and Anonymous Information with other information we may collect from you or your Products or from third parties so that we can provide and improve our Products, Services, website, advertising and other offerings.

How we share information

We work with third parties in connection with V.I.A. Services and with some aspects of the VIZIO Products and Services, such as delivering content, processing payments and providing warranty or marketing assistance. These companies may help us process information, extend credit, fulfill customer orders, deliver products to you, manage and enhance customer data, provide customer service, assess your interest in VIZIO Products and Services, or conduct customer research or satisfaction surveys. Without such Personally Identifiable Information being made available, it would be difficult for you to purchase products, have products delivered to you, receive customer service, provide us feedback to improve the VIZIO Products and Services, or access certain services, offers, and content on the VIZIO website. When we supply Personally Identifiable Information to these third parties, we require them to use it only for the function or purpose for which they are working with VIZIO.

We aggregate Personally Identifiable Information and Anonymous Information that we collect and exchange it with advertisers and other partners who are interested in the use and performance of the VIZIO Products and Services. We share this information so that our partners also may provide you with an optimal user experience and better understand how users access the VIZIO Products and Services.

We will disclose Personally Identifiable Information as required by law, or if in our judgment it is necessary to protect VIZIO or our employees or users from harm, loss or liability. If we merge with or are acquired by another company or we sell substantially all of our assets, the acquirer or resulting company will receive and may continue to use the Personally Identifiable Information you have provided, and the Anonymous Information gathered as described in this Privacy Policy.

VIZIO is a company located in Irvine, California in the United States. If you are located in Canada, Mexico or elsewhere outside of the United States, please be aware that any information we collect may be processed and transferred to the United States and be subject to U.S. law. By using VIZIO Products and Services or providing us with any information, you hereby consent to the collection, processing, maintenance and transfer of such information to and in the U.S.

How we protect information

VIZIO will maintain the confidentiality of the Personally Identifiable Information that it collects. VIZIO maintains internal practices that help protect the security and confidentiality of Personally Identifiable Information by, among other things, limiting employee access to and use of this information. When you provide VIZIO with information such as credit card numbers over the Internet, we encrypt your transmissions using SSL ("Secure Sockets Layer"), and other industry standard security technology. We keep the Personally Identifiable Information you provide on servers that are protected by firewalls and employ other industry standard security measures designed to prevent intrusion or unauthorized access. However, VIZIO does not guarantee that Personally Identifiable Information will not be disclosed to third parties for conditions beyond its control, such as third parties that circumvent security measures to unlawfully intercept or access the information.

How you can access or remove your Personally Identifiable Information

If you desire access to view, correct or remove your own Personally Identifiable Information, please contact us using the following contact information by emailing [email protected] or calling 877-698-4946. If you request removal of Personally Identifiable Information, you acknowledge that residual Personally Identifiable Information may continue to reside in VIZIO's records and archives, but VIZIO will not use that Personally Identifiable Information for commercial purposes. VIZIO reserves the right to maintain your Personally Identifiable Information if VIZIO has suspended, limited, or terminated your access to the VIZIO web site or V.I.A. Services for violating any applicable Terms of Use or the VIZIO Internet Apps Software License Agreement.

Do Not Track

VIZIO does not knowingly track personally identifiable information about visitors to VIZIO.com over different sites and over time, and it does not enable third parties to do so. VIZIO does not track site visitors as a matter of VIZIO’s commitment to privacy, regardless of whether it detects a do-not-track or similar signal from a visitor’s browser.

Postings

Where applicable, if you post user comments or engage in similar activity, please remember that anything you post may be publicly available. In other words, publicly displayed information is public. Portions of your user profile may also be available to other users of or visitors to our websites. Any such submissions to VIZIO will be public and will not be considered private information and not Personally Identifiable Information or Anonymous Information. We do not control, and are not responsible for, the actions of other users of the VIZIO web site with respect to any information you post. In addition, information that you post may be collected and used by others to send you unsolicited messages and for other purposes.

Changes to this Privacy Policy

As VIZIO's business changes and grows, VIZIO may make changes to this Privacy Policy. Please check back periodically to review these changes. If VIZIO’s changes have a significant effect on the way we use your information, however, VIZIO will announce the changes in a prominent way, which may include, for example, notification by email. VIZIO will use your information according to the latest version of the Privacy Policy. The latest version of the Privacy Policy will be available at http://www.vizio.com/privacy.
